SHEN ESSENCE UNIPESSOAL, Lda. is a company registered in Sintra that owns the trademark and domain of the Qihai website.



Qihai (i) sells natural and therapeutic products via the internet; (ii) is responsible for providing information on pharmaceuticals and phytopharmaceuticals, biocosmetics, aromatherapy, nutrition and dietetics and (iii) shares real life stories with prior authorization of its image and audio rights.



Qihai respects your privacy and your right to control your personal data. The personal data provided by users of the website will be subject to computer processing and will be included in the company's database. Whenever it is necessary to collect personal data to make it available to any third party service, such collection will be carried out in strict compliance with the General Data Protection Regulation - (Regulation (EU) 679/2016 of April 27, 2016) and related national, European and international legislation.

Payment

Payment information, such as credit card numbers, paypal and mbway, is processed by Stripe and Eupago, a PCI-certified payment service. PCI-DSS requirements help ensure the secure handling of payment information by our store and service providers.

Your data will not be retained beyond the period strictly necessary for the purposes established and in accordance with the applicable rules and laws.

We advise you to read our Terms and Conditions carefully before using our services. By registering or purchasing from our store you agree to our Terms and Conditions mentioned below. If you do not agree to any of our Terms and/or Conditions, you will not be able to use our services.


Our service consists of making available, via the address www.qihai.pt, direct access to the online store which, in addition to providing a great deal of relevant information on a range of products and/or services, allows you to electronically order the products advertised therein, under the terms and conditions described herein.

The purchase of our products must be made by users aged 18 or over (individuals under this age must be authorized by their representatives). The elements and information transmitted by the user will have full legal effect, with the user acknowledging the electronic purchases and not being able to claim the lack of signature for non-compliance with the obligations assumed.

 

2. Product Information and Content

Qihai will pay attention to any typographical errors in the description and information provided throughout the site. If you purchase a product that has different characteristics to those presented online, you have the right to withdraw from the purchase contract under the applicable legal terms.

Qihai will do its utmost to send you all the products you have ordered, but it is possible that, in certain cases and due to causes that are difficult for us to control, such as human error or computer system failures, it will not be possible to make any of the products you have ordered available. If a product is not available after you have placed your order, you will be notified by email or telephone. You will then be offered the chance to cancel the order with a refund, if you have already paid for it.

All information on price, products, specifications, promotional actions and services may be changed at any time by the Qihai team.

 

3. Responsibilities

3.1 All products and services sold in our store are in accordance with Portuguese law.

3.2 Qihai, Lda. has adequate levels of security, but is not responsible for any losses suffered by the user and/or third parties as a result of delays, interruptions, errors and suspensions of communications caused by factors beyond its control, in particular, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, the connection software or any computer viruses or resulting from the downloading (“download”) through the service of files infected or containing viruses or other properties that may affect the customer's equipment.

3.5 Qihai, Lda. shall not be liable for any loss or damage arising from non-compliance or defective compliance with the service when this is not directly or indirectly attributable to it by way of gross negligence or fault, and shall not be liable in particular for (i) errors, omissions or other inaccuracies relating to the information made available through the Service; (ii) damages caused by the fault of the user or third parties, including infringements of intellectual property, (iii) non-compliance or defective compliance resulting from compliance with judicial decisions or administrative authorities or (iv) non-compliance or defective compliance resulting from the occurrence of situations of force majeure. iii) any material obtained in any way through the use of the service is used at the user's own risk and the user is solely responsible for any damage caused to their computer system and equipment or for any loss of data resulting from such operation.

iv) no advice or information, whether oral or written, obtained by the user through our service shall create any guarantee that is not expressed in this document, General Terms and Conditions.

3.7. The user accepts that Qihai, Lda. cannot in any way be held responsible for any damage such as loss of profits, data, content, or any other loss (even if it has been previously advised by the user of the possibility of such damage occurring), resulting from:

ii) the difficulty of obtaining any substitute goods/services;

iii) unauthorized access or modification of personal databases.

 

4. Consumer obligations

4.1. The user undertakes to:

i) provide correct personal data and addresses;

ii) not use false identities;

iii) respect the order limits imposed.

4.2 If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or possible non-delivery, the responsibility lies with the user, and Qihai, Lda. declines any responsibility. In the event that the consumer violates any of these obligations, our company reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other services made available at the same time and not allow future access to any or all of the services made available by Qihai, Lda.

 

5. Privacy and Personal Data Protection

5.2 The personal data identified on the order form as having to be provided is indispensable for the provision of the service. The omission or inaccuracy of the data provided by the customer is their sole and entire responsibility and may result in the Qihai team refusing to provide the service.

5.3 The user's personal data will be processed and stored by computer and is intended to be used by Qihai, Lda. within the scope of the contractual and/or commercial relationship with the prospective client.

5.4 Under the terms of the applicable legislation, the user is guaranteed the right to access, rectify and update their personal data, either directly or upon written request.

 

6. Cancellation of orders

6.1 At the customer's request

The customer can cancel their order by contacting Qihai, Lda. by telephone or email, quoting the order number, which will be accepted as long as the order has not yet been processed. Once the order has been processed, Qihai, Lda. will try to deliver it, but the customer has the option of not accepting it.

For the purposes of cancellation, the user must provide the following information:

a) order number
b) TIN with which you placed the order and delivery address

7. Return (Right of withdrawal)

7.1. Consumers may exercise their right of withdrawal, without any compensation being required, within 7 days of receiving the delivery.

To exercise this right, the user must communicate via email (info@qihai.pt) and mention that they wish to return the products purchased together with the order number and their personal details within the aforementioned period.

The consumer must return the items to Qihai, Lda. in the proper conditions of use within 7 days from the date of the notice of withdrawal.

The packaging must be returned complete, as it was delivered and accompanied by all the documentation received, namely the following documents: sales invoice and the document proving receipt of the product. The package and the indicated documents should be sent to the following address:

If the user opts for other forms of return, the respective shipping costs will be their responsibility.

7.2 Após a receção da devolução na Qihai, Lda. o utilizador será reembolsado do montante correspondente ao valor pago pela encomenda (valor da fatura de venda, menos o valor dos portes de envio e recolha). Caso o utilizador tenha utilizado um código de desconto promocional, esse valor não será reembolsado, ou seja, o reembolso será apenas do valor efetivamente pago pelos bens ou serviços.

7.3 O método de reembolso depende do método de pagamento utilizado para a encomenda. No caso de pagamentos por cartão de crédito e PayPal, estes são creditados nas respectivas contas. Em todos os outros casos, quando é fornecida a informação do NIB, o reembolso é efectuado para a conta bancária indicada. Os reembolsos serão efectuados no prazo de 5 dias após a receção da vontade de desistência e da receção da devolução do artigo.

7.4 Se algum dos componentes do artigo vendido estiver em falta ou se algum deles não estiver em excelente estado, não será efectuado qualquer reembolso do preço e o produto será reenviado para a morada de envio original.

 

8. Defeitos de fabrico

8.1 Em caso de “defeito de fabrico”, ou seja, quando são detectadas falhas nos equipamentos que, em princípio, não se enquadram no âmbito da respectiva garantia, o utilizador deverá proceder à devolução dos artigos juntamente com uma cópia da fatura. No entanto, deverá notificar-nos previamente por e-mail (info@qihai.pt) e mencionar/descrever o dano, anomalia ou outra causa, bem como o número e identificação da encomenda, no prazo de 7 dias após a receção da entrega. 15. Communications

15.1. Whenever Qihai, Lda. deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely adjust network configurations.

Without prejudice to the provisions in the following paragraphs and considering the innovative nature of the service and potential technological developments it may undergo, Qihai, Lda. may alter the technical settings of the service whenever it deems it necessary to adapt it to technological developments.

15.3. However, Qihai, Lda. does not guarantee the user any upgrades or improvements to the service.

15.4. Some upgrades or new service features may only be available upon payment by the user and/or subscription.

 

16. Complaints

16.1. The user may submit any contractual disputes to arbitration and mediation mechanisms that are legally constituted or may be in the future, as well as file complaints with Qihai regarding actions or omissions that violate the applicable legal provisions for the acquisition of goods.

16.2. The complaint must be submitted within a maximum of 30 days from the user’s awareness of the facts, and it will be recorded in Qihai's information systems. Qihai must resolve the complaint and notify the interested party within a maximum of 30 days from the date of receipt.

 

17. Applicable Law

The contract is governed by Portuguese Law.

 

Shipping, Exchanges, and Returns

All orders are shipped from our headquarters in Sintra and transported by DPD. Delivery hours are between 09:00 and 19:00 on business days.

Once your order has been processed and shipped, you will receive a confirmation email with a tracking number to follow your order through the process until it reaches you.

At a time to be arranged with the partner, after receiving an email from us requesting collection from the selected location.

If you wish to change the delivery address of an order that has already been processed or shipped, any additional costs will be at your expense.

In case of incorrect or incomplete delivery details that prevent the carrier from making the delivery, Qihai disclaims any responsibility for delays or loss of the order. If a new shipment is necessary, the costs will be borne by the customer. The estimated delivery dates provided are merely indicative; any delay in the dispatch of products does not entitle the customer to compensation. If the customer does not claim the order from the carrier within the time allowed, and the order is returned to Qihai, the transportation costs for a new shipment will be borne by the customer.

 

TAXES AND DUTIES

If a purchase is made outside of Portugal, local import taxes and duties may apply once the order arrives in your country. We inform you that we have no control over these fees, nor can we predict them or be held responsible for them.

 

EXCHANGES AND RETURNS

As per Decree-Law No. 143/2001 of April 26, the consumer has a 14-day period to return or exchange items, provided they have not been opened, used, or damaged. The product must be returned properly packaged, in the same condition it was sent, via registered mail addressed to Qihai – Rua Alexandre Herculano, 19, r/c 1259-008 Lisbon. The invoice serves as proof of purchase and must be presented for this purpose. We also inform you that transportation costs for the return are the responsibility of the customer, except for items that were incorrectly supplied.

All items are carefully packaged in secure packaging to ensure their integrity. If you notice external damage to the product’s packaging, you should report this defect to the carrier at the time of delivery, also referencing it on the delivery confirmation document. You should also contact us immediately after receiving the damaged product.

Qihai reserves the right to reject items that appear to have been altered, used, damaged, or opened due to misuse.

 

INVOICE

If you wish to receive an invoice for your order, please provide your name, tax identification number (NIF), and address in the respective fields during the ordering process. If you do not do so, the invoice will be issued as a final consumer, and it will not be possible to reissue it.
